Abstract

This paper is an exploration and criticism of the persistent problematics in Pakistan — censorship versus freedom of speech, especially at a time when PEMRA (Pakistan Electronic Media Regulatory Authority) had come into being as a solution to regulate airwaves. Based on an analysis of PEMRA’s regulatory jurisprudence, and the wider legal architecture that controls media in Pakistan, this paper discusses what it means for press freedom and how far Pakistani media remains independent. Using key case studies as a focal point, the book demonstrates challenges, controversies and limitations of media regulation in Indonesia. Moreover, the research also examines the ways in which these regulatory practices send out signals about democratic discourse and authority (i.e., between state prerogatives of order maintenance versus media obligations to promote an informed citizenry). This paper will conclude its research by adding to the larger discussion of such practices and their inevitable repercussions on an already precarious democratic system in Pakistan. Some additional news outlets have also been temporarily blocked and the details are in a recent study that outlines specific examples of state intervention working to change legal constraints with both idealistic voices freedom, as well as democratic participation. This research highlights the importance of regulatory reforms that ensure transparency, accountability and respect for constitutional rights as enhancing media independence in a way to better serve democratic governance at Pakistan.
